Ocean Cay has an Architectural Review Committee (ARC) dedicated to maintaining
the continuity of our community which in turn promotes improvement of home
values. There are procedures to follow when you want to make a change to
the exterior of your home or landscape. Below are the procedures to follow
and some of the more common ARC Guidelines to help steer you. For complete

ARC SUBMISSION PROCEDURES FOR APPROVAL
The procedures for sending in an ARC request for any change or addition
to your home or landscaping is as follows:
1. Obtain and fill out a request form. Forms
are available on www.oceancay.com under Forms and from the management
company. 2. Mail two copies of the form and two copies of the
appropriate surveys, plans, pictures, etc., to:

2. The Continental Group, Inc. receives the forms and forwards
them to the ARC. If the forms and plans are not properly submitted they
will be returned without consideration.
3. The ARC reviews each application within 30 days.
4. The ARC decides on each application, The Continental Group, Inc. notifies
the applicant, and mails the signed original back to the homeowner.
5. Any plan that includes a pool, change of roof design (i.e. additional
room), or whose value exceeds $500 will require a $500 refundable deposit. Complete plans should be submitted with the application.
COMMON ARC GUIDELINES WITH COVENANTS, CONDITIONS & RESTRICTIONS
REFERENCES
1. OWNERS RESPONSIBILITY
Each owner shall maintain their Lot and all structures. Reference
Article VI Section 6.3
2. FENCING
On waterfront lots a maximum four foot high open style fence of aluminum
(wrought iron type) black or white (black strongly encouraged on large
lake). This is the only type allowed. Fences on the ponds must be 20 feet
from the waters edge.
On other lots, shadowbox style natural wood fence (support side facing
in towards house) no more than 6 feet in height is permitted. Other types
may be allowed on a case by case basis as determined by the ARC. All fences
must be submitted for approval. Wood fencing may not be painted or stained but may be sealed to preserve the wood with a clear finish sealer. A copy of the site plan showing the location
must be included. The type, color, material, height, and style, with photo
or drawing, must also be included. No dog runs or animal pens are permitted.

3. BASKETBALL BACKBOARDS
Permanent basketball backboards are not allowed. Portable backboards are
allowed, but must be removed from sight every night. Reference

4. SATELLITE DISHES
Dishes one meter or less in diameter are permitted, but must have ARC
approval of location so as to maintain aesthetic appearance of property.
No other exterior antennas or aerials are permitted. Reference

5. PLAY SETS
Play sets must be made of wood or similar material that does not rust
and located in the back yard, shielded from view of common areas and streets
by shrubbery or a fence. Application should include a photo or drawing
of the set, the dimensions, materials and location (site plan) and how
it will be screened. Reference Article XIV Section 14.23.11
6. POOLS, SCREEN ENCLOSURES, AND ADDITIONS
All pools, spas, screen enclosures, and external additions require ARC
approval prior to construction. Any plan that includes a pool, change
of roof design (e.g. additional room), or whose value exceeds $500 will
incur a $100 review fee and a $500 refundable deposit. Complete plans
should be submitted with the application. Screen enclosures shall not
have a flat roof. Reference Article XIII 13.2.6 and Article XIV

7. PROPANE TANKS AND WELL PUMPS
Gas tanks and well pumps are to be shielded from view, the same as air
conditioning compressors. A site plan needs to be submitted that includes
location and landscaping buffer from neighbors and street. Reference
Article XIV Section 14.23.5 and 14.23.10
8. LANDSCAPING
All new trees, shrubs, and beds must be submitted for approval, along
with a detailed site plan. Flowers and shrubs added to existing beds do
not need approval. Yards must be well maintained, groomed, trimmed, and
watered. All yards must have an operational irrigation system. All lots
shall have a least one hardwood tree in the front yard. Reference

If an owner removes a tree, the replacement trees shall be of the same
species and substantially similar in size as the tree removed. The City
of Jacksonville Beach may require a permit for removal of a tree. Contact
the Code Enforcement Department before removing any tree. Reference

All lawn ornaments (other than Holiday) must be submitted for approval.

9. SHEDS
No sheds of any kind will be allowed, including outdoor storage sheds.

10. VEHICULAR RESTRICTIONS
No commercial vehicles (see Section 14.2 for a full description of “commercial
vehicles”), campers, mobile homes, boats, trailers shall be permitted
to park or be stored at any place except inside closed garages. No overnight
on-street parking is permitted, unless prior written approval from the
Board of Directors is received. Parking on grass is prohibited. Parking
at the pool area is for the pool and playground only. Reference

11. ANIMALS AND PETS
All pets must be confined on a leash and be under the control of a responsible
person. Pets are not permitted on the Common Areas or in the pool area.
All persons will remove solid waste of their pets on other people's property.
Pets must not make objectionable noises or constitute a nuisance or inconvenience.
Per the city ordinance, the number of pets allowed is three. Reference

12. NUISANCES
No noxious, illegal, noisy, or offensive activity will be tolerated in
the community. Reference Article XIV Section 14.5
13. TRASH
Trash receptacles can be placed curbside (not in the street) no earlier
than dusk the day before pickup and should be removed by dusk on the day
of pickup. Trash receptacles must be kept in the garage or on the side
of a lot and screened from view from rights-of- way and common areas.

14. SIGNS
No sign can be displayed within the properties without written consent
of the ARC, except those required by legal proceedings. This includes
posters or cards attached to posts, fences or mailboxes. Realtor signs
must be the green and beige architectural type. Reference Article

15. BUSINESS USE
No trade or business may be conducted if the existence of the business
activity is apparent or detectable by sight, sound or smell from outside
the lot; the business activity involves persons coming onto the residential
properties who do not reside in the properties or the business constitutes
a nuisance, hazard or is offensive and threatens the safety of other residents.

16. LEASING LOTS
Lots may be rented in their entirety. There shall be no subleasing. All
leases shall be in writing. The minimum lease term is seven months. Reference

17. ARCHITECTURAL APPROVAL
Roof and exterior wall paint colors shall be coordinated and submitted
